TERMS AND CONDITIONS OF SALE

These Terms & Conditions (the “Terms”) govern your booking with The Ibiza Social Club (“we”, “us”, “our”, “Supplier”). We are registered in England and Wales under company number 16454230, with a registered office at 4 Cornhouse Buildings, Rayleigh, Essex.
These Terms apply to all bookings made via our website, any booking platform we use, and any charter services, experiences, goods or ancillary services you purchase from us (the “Services”).
By making a booking, you agree to be bound by these Terms.
1. DEFINITIONS
Customer / “you”: The person making the booking
Booking Confirmation: The email confirming your booking
Services: Any charter, excursion or related service
Deposit: paid to secure your booking
Balance: Remaining amount due
2. CONTRACT FORMATION
2.1 A booking constitutes an offer to purchase Services.
2.2 A contract is formed only when:
* we issue a Booking Confirmation; and
* the deposit has been received in cleared funds.
2.3 These Terms apply to the exclusion of any other terms unless agreed in writing.
3. PRICING & PAYMENT
3.1 A deposit is required to secure your booking.
3.2 The remaining balance must be paid by the date specified in your Booking Confirmation.
3.3 If the balance is not paid on time, we reserve the right to cancel your booking and retain any payments made.
3.4 Prices are as stated at the time of booking and may be subject to taxes, fees or currency conversion charges.
3.5 Payments are processed via third-party providers.
4. CANCELLATION & REFUNDS
4.1 Cancellation by You
(a) More than 35 days before departure: deposit refunded in full. This does not apply to self-drive boat bookings, which are non-refundable once booked
(b) 35 days or less before departure: deposit non-refundable
The non-refundable deposit reflects loss of booking opportunity and administrative costs incurred.
4.2 Changes
Requests to change date, time or Services are subject to availability and may be treated as a cancellation.
4.3 Refunds
Refunds will be made less any non-recoverable third-party fees (including payment processing and platform charges).
4.4 Late Arrival / No-Show
Failure to arrive at the agreed time may result in reduced charter time or cancellation without refund.
5. WEATHER & RESCHEDULING
5.1 Safety is our priority. If conditions are deemed unsafe by the captain:
* we will attempt to reschedule; or
* if not possible, a full refund of payments made will be issued.
5.2 All decisions relating to weather and safety are at the sole discretion of the captain and are final.
6. SAFETY & PARTICIPATION
6.1 A safety briefing will be given before departure.
6.2 You must follow all instructions given by the captain and crew at all times.
6.3 Boat surfaces may be slippery and conditions at sea may be unpredictable.
Participation in marine activities carries inherent risks. By attending, you acknowledge and accept these risks.
6.4 We reserve the right to modify or terminate a charter without refund if safety instructions are not followed.
7. MARINA & BOARDING RULES
7.1 Appropriate clothing must be worn when entering and exiting the marina.
7.2 Large glass bottles of spirits are not permitted.
7.3 You must respect marina staff, property and surrounding residents.
7.4 Aggressive or abusive behaviour will result in removal without refund.
8. BEHAVIOUR, ALCOHOL & SUBSTANCES
8.1 Sensible alcohol consumption is expected.
8.2 Illegal substances are strictly prohibited.
8.3 The captain may refuse boarding or terminate the charter if behaviour compromises safety.
9. DAMAGE & RESPONSIBILITY
9.1 You are responsible for any damage to the vessel or equipment caused by negligence, misconduct or failure to follow instructions.
9.2 Costs of repair or replacement may be charged accordingly.
10. LIABILITY & INSURANCE
10.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by law.
10.2 To the fullest extent permitted by law, our total liability shall be limited to the total amount paid by you for the Services.
10.3 We are not responsible for loss, theft or damage to personal belongings.
10.4 You are responsible for obtaining appropriate travel insurance covering cancellation, personal injury and loss.
11. FORCE MAJEURE
We are not liable for failure to perform our obligations due to events beyond our reasonable control, including but not limited to:
-severe weather
-port closures
-mechanical failure
- crew illness
-government restrictions
-civil unrest
12. COMPLAINTS
Any complaint must be submitted in writing within 30 days of your charter using the contact details provided in your Booking Confirmation.
13. GOVERNING LAW & JURISDICTION
13.1 These Terms are governed by the laws of England and Wales.
13.2 The courts of England and Wales shall have exclusive jurisdiction.
13.3 All charters and onboard conduct are subject to Spanish and Balearic maritime laws.
13.4 Where there is any conflict, applicable maritime safety laws shall take precedence.
14. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version applicable will be the one in force at the time of your booking.
